KUALA LUMPUR, July 1, 2015:<br />

CIMB Group Holdings Bhd and its Indonesian unit PT CIMB Niaga TBK today announced that a total of 3,599 staff are leaving the firms under the Mutual Separation Scheme (MSS) exercise which ended on May 29 this year.<br />
In a statement, CIMB Group said the management had approved applications from 1,891 in Malaysia and 1,708 in Indonesia.<br />
It said the staff leaving represents a rationalisation of 11.1% of the total workforce in Malaysia and Indonesia.<br />
“While the group will incur approximately RM443.3 million in MSS cost, the resultant savings from the headcount reduction is estimated to be RM291.6 million per annum, which translates to an 18.2 months payback.”<br />
CIMB Group chief executive Tengku Datuk Zafrul Tengku Abdul Aziz said: “With the completion of the MSS, we are on track to meet the targets set in our cost-to-income plans outlined in our T18 strategy.”<br />
<br />
The total number of staff leaving the banking group is far higher than had originally been projected.<br />
It has been reported that the banking group has already slashed 15 jobs at its Singaporean unit and cut a total of 150 jobs across its Asian units (namely Hong Kong, Taiwan, South Korea and India) as well as pulling out its Australian unit – which saw 103 jobs lost there.<br />
CIMB Group had reported a pretax loss of RM64.1 million at company level in the first quarter ended March 31, 2015 compared to RM937.56 million previously – largely due to non-interest income plunging to RM876,000 from RM989.07 million in the same quarter of 2014.<br />

We, the undersigned 66 civil society organisations, trade unions and concerned groups, are disturbed by the Malaysian government’s unjust use of an Act of Parliament to suspend and/or deny existing worker rights in law, including also access to justice mechanisms, for the benefit of a private business and employer, being the Malaysian Airlines System Berhad (MAS Bhd), now a wholly-owned private company by Malaysia’s Khazanah Nasional Berhad.<br />
<br />
Malaysia tabled and passed speedily the Malaysian Airline System Berhad (Administration) Act 2015 [Act 765], which came into force on 20/2/2015. This Act is most unjust to workers and trade unions of employees of the airline.<br />
<br />
The Act, in section 11, states that “...on the appointment of the Administrator, a moratorium shall take effect during which... (e) no proceedings and no execution or other legal process in any court or tribunal may be commenced or continued with, and no distress may be levied, against the Administered Companies or their property except with the prior written consent of the Administrator;” - whereby the Administered company includes MAS Bhd, its wholly owned subsidiaries and some partially owned subsidiaries. The Administrator was appointed on or about 25/5/2015, and the period of administration could last for a maximum period of two years commencing from the date of the appointment of the Administrator.<br />
<br />
What is disturbing is that when administration and moratorium ends, all monies, assets and business of MAS Bhd would most likely be transferred to a new legal entity Malaysian Airline Berhad(MAB). MAS Bhd would most likely be left an empty shell.<br />
<br />
Rights cases against MAS Bhd stopped<br />
<br />
There are currently many cases initiated and filed, now pending before access to justice mechanisms, including tribunals and courts between workers and MAS Bhd, the employer, claiming wrongful dismissal and/or other worker rights, or between trade unions and MAS Bhd. The effect of the moratorium is that all these actions and cases will stop, and not proceed further until administration of MAS Bhd ends.<br />
<br />
At the end, when moratorium is lifted, MAS Bhd would most likely be an empty shell - with no work and no money. Hence, it will be workers and trade unions that will suffer. Workers and trade unions do not just lose their right to justice, but also will have to shoulder additional loses, including all the monies utilised for lawyer and court fees, time and others.<br />
<br />
For many workers, it may also mean loss of wages for the days they could not work because they had to attend at relevant departments, tribunal or court in their pursuit for justice. Hence, not only will workers and trade unions be denied justice, but will suffer even more injustice by reason of this anti-worker legislation.<br />
<br />
Right to join parties to satisfy worker claims denied<br />
<br />
Normally, when the employer has lost the ability to provide remedies, damages or compensation to satisfy the claims of the worker, to ensure justice, the worker can proceed with an application to join third parties to the suit, possibly the owners (Khazanah Nasional) or others.<br />
<br />
This MAS Act now unjustly prevents this ability to join parties, in amongst others, in section 25(2), which states that “ The Malaysia Airlines Berhad, the appointer and the Administrator shall not be named as a party in any claim or application made or joined as a party in any proceeding commenced or continued by or on behalf of any employees or former employees of the Administered Companies pursuant to the Industrial Relations Act 1967 [Act 177], Employment Act 1955 [Act 265], Sabah Labour Ordinance 1950 [Sabah Cap. 67], Sarawak Labour Ordinance 1952 [Sarawak Cap. 76] or the Trade Unions Act 1959 [Act 262].’<br />
<br />
In fact, section 25(1) says clearly, amongst others, that ‘...the Administered Companies, the Administrator, appointer or the Malaysia Airlines Berhad shall not - (a) be regarded as the successor, assignee or transferee or a successor employer to the Administered Companies; (b) be liable for any obligation relating to any retirement plan or other post-employment benefit plans in respect of the employees or former employees of the Administered Companies or any predecessor of the Administered Companies that exists prior to the assumption of control or appointment; or (c) be liable for any sum which is calculated by reference to a period of time prior to the Malaysia Airlines Berhad becoming the employer of the person in question…’<br />
<br />
Same owner of both MAS Bhd and new Malaysian Airline Berhad (MAB)<br />
<br />
Considering that the it is Khazanah Nasional that is the sole owner of MAS Bhd, and also the new company MAB, clearly all that is happening is really nothing other than the ‘same person changing shirts’ - and justice would demand that the new entity MAB or the owner, Khazanah, should be justly taking over the obligation and responsibility of MAS Bhd especially for cases involving worker and trade union rights.<br />
<br />
The new MAB and MAS Bhd, both owned by Khazanah, really is nothing other that the same owner forming a new company to escape responsibility and liability to workers, is also supported by the following:-<br />

Christoph Mueller, the new chief executive of MAS Bhd, was appointed on 1/5/2015, would later assume the same position with MAB. Same CEO for MAS Bhd, and new MAB?<br />
When the employees of MAS Bhd received their termination letters in early June 2015, those that were offered employment by the new MAB, were offered a different termination package from those not offered employment in MAB. Those offered employment in MAB, which was to take effect from 1/9/2015, were asked to continue coming in to work in MAS Bhd, while the others, about 6,000, were asked to stop coming in to work with the assurance they will continue to receive normal salary but could not commence employment with another employer before Aug 31, 2015 unless they first get approval of MAS Bhd’s Human Resource Department. For many airline employees, other than basic wages, income from allowances and such if they are working makes up sometimes 50 percent or more of their monthly take home income. Rightly, all employees of MAS Bhd, irrespective of whether they will be later employed in MAB, should have received the same benefits and ex-gratia on termination by MAS Bhd.<br />
In the name of justice, MAB or Khazanah or the Malaysian government should really take over the obligation of any or all claims of employees and trade unions against MAS Bhd.<br />

<br />
Avoiding just principles of lay-off and termination<br />
<br />
When an employer wants to reduce staff, they would justly retrench the number of workers they no longer need - and there are just requirements that need to be complied in any retrenchment exercise like the ‘Last In First Out’(LIFO) principle. Here, this is avoided by MAS Bhd simply terminating all employees on Aug 31, 2015. Justly, the about 6,000 who were no longer required to come into work since June, should have been laid off then and there and paid all their entitlements.<br />
<br />
Union busting?<br />
<br />
With the termination of all employees of Malaysia Airlines Systems Bhd (MAS Bhd), it would also mean the demise of about seven in-house trade unions.<br />
<br />
The only national trade union, the National Union of Flight Attendants Malaysia (Nufam), managed to show support of 62.73 percent of the qualified employees, and obtain the minister’s order that made it a recognised union in MAS Bhd. Rather than accept this, MAS Bhd went for judicial review challenging the minister’s decision.<br />
<br />
Nufam alleges that only two out 10 executive committee members of the union, who are employees in MAS Bhd have been offered employment in the new MAB.<br />
<br />
As such, this ‘restructuring exercise of the airline’ and this new law can also be considered a means of union busting.<br />
<br />
Loss of regular employment until retirement<br />
<br />
Many workers who are regular employees until retirement in MAS Bhd, who have been offered employment in the new MAB find that they will now become precarious employees on short-term contracts, some even on three or six months employment contracts. There is no law in Malaysia that stipulates that short-term contract employees will continue as employees if the work they were hired to do still exist.<br />
<br />
Short-term and other precarious forms of employment also would likely deter union formation or involvement, deter workers from claiming rights and facilitate easier exploitation of workers.<br />
<br />
Ignoring workers’ and families’ financial security and well-being<br />
<br />
Workers in Malaysia have families and dependents, and also many now have monthly loan-repayment obligations, and justly they should be provided secure regular employment until retirement, whereby they still could be terminated for misconducts, or laid off where the employers has to reduce jobs.<br />
<br />
Whilst Malaysia says that it is concerned about the airline business, it has demonstrated a serious lack of concern for the welfare and well-being of workers.<br />
<br />
We therefore urge:<br />
<br />
That the said Malaysian Airline System Berhad( Administration) Act 2015 be repealed, and the effect this Act has had on workers and trade unions be reversed. No law should be enacted to suspend/deny worker rights for selected employers;<br />
<br />
That all pending cases with regard to labour matters, be it with workers or unions, shall be justly resolved or settled forthwith by MAS Bhd, and its owners Khazanah Nasional;<br />
<br />
That for all worker and trade union cases against MAS Bhd, MAB and Khazanah Nasional shall agree to be joined in as parties and assume obligations of MAS Bhd to workers;<br />
<br />
That if the Malaysian Airlines is desirous of reducing the number of employees, it be done by letting go employees in compliance with the Last In First Out (LIFO) principle and other established just legal principles;<br />
<br />
That if the Malaysian Airlines is to be taken over by another entity, like the Malaysian Airlines Berhad (MAB), workers should be employed by MAB as secure regular employees and not by means of precarious forms of employment like short-term contracts;<br />
<br />
That Malaysia considers the rights, welfare and wellbeing of workers and their families are just as important, if not more, than the wellbeing and profits of government-owned or linked businesses. <br />

MAS offers over 14k staff jobs at new company<br />

Malaysia Airlines Bhd is inviting at least 14,000 employees to join a new company formed as part of a corporate revamp as the carrier seeks to return to profitability after two disastrous accidents last year.<br />
The carrier, which has about 20,000 workers, said turnaround plans for this year include so-called capacity rightsizing, eliminating sources of losses, and renegotiating key contracts according to emailed presentation slides today.<br />
The old structure, Malaysian Airline System Bhd, will cease operations in August and selected assets and liabilities will be transferred to the new company.<br />

The airline will start to grow again in 2017-2018, The Edge reported today, citing chief executive officer Christoph Mueller (photo). It will break even in 2018 and the focus this year is to stop the “bleeding,” the New Straits Times quoted Mueller as saying.<br />

Malaysia Airlines is seeking to reinvent itself after stiff competition led to years of losses, even before flight MH370 disappeared in March last year and MH17 was shot down over Ukraine.<br />

The new company will reduce capacity and expand its more profitable domestic and regional routes in Asia Pacific, parent and sovereign wealth fund Khazanah Nasional Bhd said in March.<br />
Mueller joined Malaysia Airlines from Dublin-based Aer Lingus Group Plc, which he turned around in the face of competition from budget airline Ryanair Holdings Plc. He faces a similar task as Malaysia Airlines struggles to fend off AirAsia Bhd, one of the region’s largest low-fare carriers.<br />

In August, Khazanah announced plans to cut 6,000 jobs after the carrier amassed more than RM4.9 billion in losses since the start of 2011. Tahun lalu, Khazanah mengumumkan pakej RM6 bilion untuk mengurangkan 30 peratus atau 6,000 pekerja sedia ada MAS bagi membolehkan syarikat tersebut kembali menjana keuntungan dalam tempoh tiga tahun, atau menjelang 2017.<br />

Rancangan itu turut melibatkan penubuhan satu syarikat baru untuk mengambil alih aset dan perniagaan syarikat lama.<br />

Nufam president Ismail Nasaruddin demanded that Khazanah Nasional Berhad, which owns 70% of shares in MAS and is overseeing restructuring operations, consult MAS in-house unions and threatened to picket if this is not done before downsizing starts in June.<br />

"We will object to any termination letters and will picket if they do not consult us about the restructuring exercise.<br />
<br />
"We hope the Prime Minister will pay attention to the issues MAS workers are facing; we do not want to picket and oppose the government, we only want open and harmonious discussions," Ismail told a press conference at the Crystal Crown Hotel today.<br />
<br />
He said MAS' financial predicament is due to mismanagement and leakages from the top, and it is the management that needs to be restructured.<br />
<br />
As proof, Ismail said he has data and financial records which he will reveal "when the time is right", and that reports have already been lodged with the Malaysian Anti-Corruption Commission (MACC) in January and February.<br />

ITF Malaysia Chapter secretary-general Tan Sri Zainal Rampak said the restructuring has been taking too long and MAS' 20,000 employees have been left to wonder if they will be axed.<br />
<br />
"Why is Khazanah not taking any proactive measures to solve the problems faced by these 6,000 employees?" Zainal asked.<br />
<br />
MTUC secretary-general N. Gopal Krishnan said Khazanah is under the Finance Ministry of which Najib is the minister, thus he has to ensure that the job is done properly.<br />
<br />
Gopal asserted that cutting MAS' workforce by 30% does not amount to restructuring the airline, noting that the carrier had been downsized to 18,000 employees in 2006, only to have 2,000 of them re-employed.<br />
<br />
He added that changing one or two persons in the top management does not equal to a revamp, and more needs to be done to save MAS.<br />
<br />
MAS lost RM1.17 billion in the 2013 fiscal year, and the MH370 and MH17 twin tragedies exacerbated its financial performance throughout 2014 as customers lost confidence in the airline and the safety of air travel.<br />

Bencana yang menimpa Syarikat Penerbangan Malaysia(MAS)kesan kerugian yang ditanggungnya telah menyebabkan kerajaan terpaksa mengambil langkah menutup operasinya dan melakukan pelan pemulihan semula Syarikat penerbangan kebanggaan negara itu. MAS mengalami kerugian bersih RM443 juta dalam suku tahun pertama 2014 dan dianggar kini mencecah RM7 juta sehari. Laporan akhbar melaporkan MAS membelanjakan kira-kira RM2.4 billion untuk menampung kos pekerjanya yang berjumlah 19,577 pada tahun 2013. Keadaan kewangan dan operasi MAS menjadi bertambah tenat apabila terjadi trajedi kehilangan pesawat MH370 sejak setahun lalu dan jatuhnya pesawat MH17 yang dalam perjalanan dari Amsterdam ke KLIA di kawasan bergolak Russia dan Ukraine.<br />
<br />
Kerajaan telah mengorak langkah melakukan pelan pemulihan semula MAS dengan membentangkan Rang Undang-Undang MAS 2015 (http://www.federalgazette.agc.gov.my/outputaktap/20150105_AKTA%20765_BI_MAS%20%28Administration%29%202015_1.pdf). Pembentangan Rang Undang Undang MAS 2015 telah diluluskan oleh parlimen pada 27 November 2014. Rang Undang-Undang itu antara lain bertujuan untuk mengadakan peruntukan bagi pentadbiran Malaysian Airline System Berhad (MAS), syarikat subsidiari milik penuh dan milik separanya.<br />
<br />
Ia juga akan menyediakan peruntukan bagi penubuhan entiti baharu dikenali sebagai Malaysia Airlines Berhad yang akan menggantikan MAS sebagai syarikat penerbangan nasional. Menteri di Jabatan Perdana Menteri, Datuk Seri Abdul Wahid Omar membentangkan rang undang-undang itu untuk bacaan kali ketiga sebelum diluluskan selepas mendapat majoriti persetujuan daripada anggota Dewan (http://www.sinarharian.com.my/ultras/liga-malaysia/dewan-rakyat-lulus-rang-undang-undang-mas-1.337206)<br />
<br />
Rang Undang-Undang itu mempunyai 37 fasal dan enam bahagian yang mana ia dibahaskan 10 ahli Parlimen membabitkan lima dari Barisan Nasional (BN) dan lima dari pembangkang sejak pukul 11.30 pagi sebelum ianya diumum diluluskan kira-kira pukul 4.45 petang oleh Yang Dipertua Dewan Rakyat Tan Sri Pandikar Amin Mulia.<br />

Antara ciri-ciri utama dalam rang undang-undang itu ialah membolehkan (MAS) beroperasi pada kos yang munasabah dari kos bekalan, perkhidmatan, kakitangan termasuk kaedah-kaedah kerja dan terma-terma untuk kakitangan baharu. <br />

Rang Undang-Undang tersebut mendapat bantahan keras dari Kesatuan Sekerja MAS - National Union of Flight Attendants Malaysia (NUFAM) (http://www.themalaymailonline.com/malaysia/article/airline-crew-union-cries-foul-against-proposed-mas-act#sthash.ASbI99ZK.dpuf). NUFAM membantah dan mendakwa pihak pengurusan MAS dan semua pihak yang terlibat dalam penyediaan Rang Undang-Undang tersebut telah mengenepikan pandangan Kesatuan Kesatuan Sekerja dalam Syarikat MAS. Rang Undang-Undang tersebut dengan nyata memberikan imuniti kepada Syarikat MAS dari sebarang tindakan undang-undang dan menyekat Kesatuan Sekerja dari mengguna pakai peruntukan Akta Kesatuan Sekerja 1955 terhadap MAS.<br />
<br />
Selain NUFAM,Malaysia Airlines System Employees Union (MASEU), Malaysia Airlines Employees Union Peninsular Malaysia dan Malaysia Airlines Pilot Association merupakan antara Kesatuan Sekerja yang ujud di MAS. Presiden MASEU, Alias Aziz yang sudah menerajui MASEU sejak 20 tahun lalu mendakwa tidak dijemput oleh pengurusan MAS untuk taklimat berhubung cadangan penstrukturan semula syarikat penerbangan kebangsaan itu (http://aans1.blogspot.com/2014/08/jangan-kurang-ajar-dengan-kakitangan-mas.html). <br />
<br />
Bukan menjadi satu rahsia dikalangan pemimpin kesatuan sekerja di negara ini bahawa terdapat pergeseran antara sesama Kesatuan-Kesatuan yang ujud di MAS sejak sekian lama. Pergeseran ini telah menyebabkan hilang kemuafakatan diantara Kesatuan-Kesatuan Sekerja MAS dalam menangani isu pekerja. Sewajarnya Kesatuan-Kesatuan Sekerja di MAS mengenepikan sementara semua isu dalaman dan memberi tumpuan dan fokus kepada isu besar yang bukan sahaja mengancam periuk nasi ribuan pekerja malah mampu menimbulkan ketidak tentuan dalam halatuju Kesatuan-Kesatuan Sekerja di MAS. Difahamkan MASEU bakal mengadakan mesyuarat tergempar dalam masa terdekat bagi membincangkan halatujunya kesan dari pelan pemulihan syarikat MAS.<br />
<br />
Ternyata pegeseran dalaman Kesatuan-Kesatuan Sekerja MAS telah membuka ruang luas kepada pengurusan MAS dan semua pihak yang terlibat dengan penstrukturan semula MAS mengambil kesempatan melakukan apa sahaja keputusan tanpa melibatkan rundingan dengan pihak Kesatuan Sekerja MAS. Sehingga kini difahamkan tidak ada satupun rundingan dilakukan dengan mana-mana Kesatuan MAS untuk membincangkan nasib dan masa depan pekerja-pekerja MAS. Berita pembuangan lebih 6000 pekerja MAS telah awal-awal diumumkan oleh pihak Khazanah Nasional dan Pengurusan MAS namun butiran terperinci mengenainya masih gagal didedahkan sehingga ke hari ini. Sumber Kesatuan MAS melaporkan surat pemberhentian kerja kepada lebih 6000 pekerja bakal dikeluarkan oleh pengurusan MAS seawal 16 March 2015. Lansung tiada sebarang maklumat diterima oleh Kesatuan Sekerja MAS berhubung syarat-syarat dan kriteria pemilihan pekerja yang bakal diberhentikan.<br />
<br />
Kesatuan-Kesatuan Sekerja GLC wajar mengambil ikhtibar dan pengajaran dari krisis MAS. Hari ini pekerja MAS sedang berdepan dengan situasi yang amat getir yang antara lain berpunca dari pergeseran dan hilang kemuafakatan dikalangan Kesatuan-Kesatuan Sekerja MAS. Semangat 'Solidarity' tidak sepatutnya menjadi slogan kosong pemimpin-pemimpin Kesatuan Sekerja tetapi ianya perlu direalisasikan demi menjaga kepentingan dan kebajikan pekerja. Rang Undang-Undang MAS 2015 yang diluluskan telah menjadi 'Precedence case' untuk rujukan dimasa depan. Syarikat-Syarikat GLC kini maju setapak kedepan melalui langkah kerajaan dan Khazanah Nasional dengan melihat satu option yang terbuka luas bagi mengatasi masalah operasi dan mengurangkan pekerja. Bila-bila masa Syarikat GLC yang bermasalah boleh membuat Rang Undang-Undang baru dengan kelulusan Parlimen bagi menggantikan Rang Undang-Undang yang ada dan sekaligus melupuskan segala obligasi terhadap terma dan syarat perkhidmatan antara pekerja dan syarikat-syarikat GLC sepertimana yang dilakukan oleh MAS.<br />
<br />
Krisis MAS tidak boleh dipandang ringan oleh mana-mana Kesatuan Sekerja dan pekerja-pekerja Syarikat GLC. Krisis ini menjadi pembuka laluan dengan modus operandi yang sama bakal dihadapi oleh mana-mana pekerja Syarikat GLC. Kesatuan Sekerja di MAS perlu bangkit bersatu demi masa depan pekerja dan kembali menyusun pemuafakatan bagi menghadapi isu ini. Malah pekerja-pekerja Syarikat GLC lain juga wajar melakukan mobilasasi pekerja bagi menjadi benteng untuk bersama mempertahankan hak pekerja MAS. Sudah tiba masanya slogan popular dunia Kesatuan Sekerja 'An injury to one is an injury to all' diterjemahkan kepada tindakan bersama semua pemimpin Kesatuan untuk mempertahankan hak pekerja-pekerja MAS.<br />

Kesatuan telah beberapa bulan cuba mencari jalan penyelesaian untuk mendampingi isu pekerja dengan pihak syarikat Nasional Malaysia Airlines tetapi ia masih gagal mendapat reaksi dari pihak syarikat MAS yang masih berdegil untuk berdepan dengan perwakilan Kesatuan Kebangsaan.<br />

NUFAM memohon kerajaan Malaysia agar semua isu isu kerugian syarikat diselesaikan dahulu sebelum proses pengstrukturan pekerja dilakukan.<br />

Kezaliman syarikat MAS & Khazanah untuk melepaskan 6,000 pekerja yang telah lama berkhidmat amat dikesali kerana pihak pengurusan tinggi kedua dua pihak sehingga hari ini masih berleluasa dan tiada apa apa tindakan diambil atas kerugian besar syarikat tersebut.Tiada apa apa tindakan juga yang diambil oleh pihak Kementerian yang berkuasa untuk memastikan pekerjaan pekerja di MAS dapat dilindungi.Yang nyata sekali, pihak pengurusan MASlah yang harus dipersalahkan atas kerugian besar ini dan bukan pekerja pekerja bawahan syarikat tersebut.<br />

PEMBUANGAN KERJA TANPA NOTIS PEMIMPIN KESATUAN<br />
<br />
Sidang akhbar hari ini ingin mengumumkan bahawa seramai sebelas (11) pemimpin Kesatuan Pekerja – Pekerja KTMB terdiri dari Presiden, Timbalan Presiden, Naib Presiden, Setiausaha Agung, Penolong Setiausaha Agung, Bendahari Agung, Penolong Bendahari Agung empat (4) pemimpin cawangan serta seorang (1) ahli kesatuan, telah “dibuang kerja tanpa notis”, manakala seramai tiga belas (13) pemimpin kesatuan telah “digantung kerja” manakala baki seramai lapan puluh enam (86) iaitu pegawai cawangan serta ahli kesatuan yang menerima “notis tunjuk sebab” sedang dalam proses menunggu giliran gantung kerja seterusnya “dibuang kerja tanpa notis”, pihak KTMB juga sedang mengenalpasti semua ahli-ahli RUM yang berpiket seramai tujuh ratus (700) orang melalui gambar atau video yang dirakam untuk mengambil tindakan tatatertib, tindakan tatatertib yang diambil adalah sekadar ingin menunjukan bahawa prosedur tindakan tatatertib berdasarkan “natural justice” kononnya dipatuhi.<br />
<br />
Pembuangan kerja ini adalah disebabkan berikutan tindakan “PIKET” yang dianjurkan oleh Kesatuan Pekerja-Pekerja KTMB pada 9 Mei 2014 iaitu menuntut Datuk Elias Kadir, Presiden KTMB ditamatkan perkhidmatan, tindakan Piket ini dilakukan demi “SELAMATKAN KTMB, SELAMATLAH PEKERJA”, bersama ini disertakan “pamplet edaran kesatuan” untuk senang rujukan, sebagai sebab mengapa Datuk Presiden KTMB perlu ditamatkan, mengikut rekod dalam sejarah KTMB, inilah Presiden KTMB yang terburuk prestasinya yang mana pihak kesatuan telah menganugerahkan gelaran “NON PERFORMING PRESIDENT”.<br />
Berdasarkan surat pertuduhan yang diterima tindakan KTMB menggunakan perkataan salah laku sebagai “pekerja” adalah “dengan niat jahat” disebabkan kehadiran pemimpin dan ahli-ahli kesatuan ketika berpiket adalah atas “platform Kesatuan”. Pertuduhan selanjutnya ialah berkaitan kenyataan-kenyataan kesatuan melalui Facebook “Suara RUM” dan “Bena Piket Kesatuan”, kenyataan sedemikian adalah kenyataan rasmi Kesatuan Pekerja-Pekerja KTMB, ianya adalah selaras dengan peruntukan yang terdapat dalam Akta Perhubungan Perusahaan 1967 (Akta 177) iaitu kesatuan berhak menjalankan aktiviti-aktiviti Kesatuan Sekerja.<br />
<br />
KTMB yang diketuai oleh Datuk Elias Kadir selaku Presiden KTMB telah bertindak “ZALIM” dengan mengambil tindakan “pembuangan kerja tanpa notis” atas sebab yang tidak dilakukan di bawah peruntukan “PERJANJIAN BERSAMA”, pembuangan kerja ini diibaratkan satu tindakan “BALAS DENDAM” dan bersifat “PERSONAL”, lebih menjurus satu tindakan menggunakan “undang-undang rimba” yang membelakangkan peruntukan undang-undang, pihak kesatuan dengan tegas menyatakan bahawa Datuk Elias Kadir Presiden KTMB telah “menyalahgunakan kuasa” untuk mengambil tindakan yang tidak bertamadun dan satu penganiayaan kepada pekerja yang menjalankan tanggungjawab sebagai ahli kesatuan selaras dengan Perlembagaan Kesatuan.<br />
Berdasarkan “track record” KTMB dan “government own company (GOC)” maka inilah pertama kali dalam sejarah pembuangan kerja berlaku, pada tahun 1962, Mogok keretapi terbesar dalam negara melibatkan satu tempoh yang panjang selama dua puluh tiga (23) hari tiada seorang pekerja dibuang kerja, malah tindakan itu telah merumuskan satu kejayaan pada ketika itu untuk menikmati gaji bulan berbanding sebelum itu gaji hari, malah melalui tindakan tersebut semua kakitangan awam turut menikmati faedah atas mogok tersebut.<br />
<br />
Tindakan pembuangan kerja ini, akan menimbulkan implikasi dan menjejaskan nama baik YAB Dato’ Sri Haji Mohd Najib bin Tun Haji Abdul Razak, Perdana Menteri Malayisa merangkap Menteri Kewangan berdasarkan Keretapi Tanah Melayu Berhad adalah milik Kementerian Kewangan yang diperbadankan, makanya tindakan Presiden KTMB secara langsung telah terpalit kepada Kementerian Kewangan yang mewakili Kerajaan Malaysia iaitu seolah-olah Presiden KTMB dengan sengaja cuba memburukkan Kerajaan Malaysia yang saya yakini tidak akan merestui tindakan sebegini apatah lagi ianya bertentangan dengan hak kebebasan bersuara seperti terkandung dalam Perlembagaan Persekutuan.<br />
Bagi pihak Majlis Eksekutif kami memohon, YAB Dato’ Sri Haji Mohd Najib bin Tun Haji Abdul Razak, Perdana Menteri Malaysia segera campurtangan dengan menyelesaikan kemelut ini dengan segera, demi memastikan tiada pekerja dan keluarga mereka teraniaya dengan tindakan “ZALIM” yang dilakukan oleh Datuk Elias Kadir, Presiden KTMB.<br />

<b>PUTRAJAYA 27 Mei</b> - Kesatuan dan Persatuan Sekerja Tenaga Nasional Berhad (TNB) yang mewakili 34,900 pekerjanya mahu penganugerahan projek penjanaan dibuat secara bidaan terbuka bagi membolehkan rakyat menikmati kadar tarif elektrik yang rendah.<br />

Yang Dipertua Persatuan Eksekutif Tenaga Nasional Berhad (PETNB), Abdul Shukor Hassan berkata, bidaan secara terbuka itu membolehkan penjana tenaga bebas (IPP) menawarkan harga pembelian yang lebih murah berbanding rundingan secara terus.<br />

Beliau berkata, rakyat seterusnya akan mendapat manfaat kerana tidak terbeban dengan kos penjanaan yang tinggi sekiranya sesuatu projek itu diserahkan secara terus kepada mana-mana IPP.<br />
<br />
"Penganugerahan projek secara terbuka juga membolehkan IPP yang ada bersaing secara sihat antara satu sama lain untuk membekalkan tenaga elektrik.<br />
<br />
"Secara tidak langsung membolehkan proses bidaan berlangsung secara telus tanpa ada sebarang maklumat tersembunyi berbanding rundingan secara terus," katanya kepada pemberita selepas mengadakan pertemuan dengan Pengerusi Suruhanjaya Tenaga, Datuk Abdul Razak Abdul Majid di sini hari ini.<br />
<br />
Pertemuan hampir dua jam itu dihadiri oleh 16 wakil daripada PETNB, Kesatuan Percantuman Pekerja-pekerja TNB (KPPPTNB) dan Kesatuan Pegawai-pegawai Rendah TNB (KPPRTNB) .<br />
<br />
Mengulas lanjut, Abdul Shukor berkata, penganugerahan rundingan secara terus perjanjian pembelian kuasa (PPA) antara TNB pada keseluruhan IPP generasi pertama hanya akan meningkatkan kos operasi.<br />
<br />
"Bayangkan jumlah bayaran sudah dibuat selama ini kepada keseluruhan IPP generasi pertama yang diberi secara rundingan terus.<br />
<br />
"Kadang-kadang jelas kelihatan isu membabitkan sesetengah IPP sebelum ini adalah berat sebelah," katanya.<br />

Indonesians are demanding a rise in the minimum wage and a ban on employing contract workers - two problems they cite as barriers to improving their welfare.<br />

Said Iqbal, one of three labour leaders representing the Alliance for Labour Unions in Indonesia (MPBI), said: "We are forcing, not asking, the government to amend the laws to limit (contract jobs) and implement a better wage system. There will be no compromise until there is a change or more transparency."<br />
<br />
Labour groups are also denouncing comments by Sofyan Wanandi, chairman of the Indonesia Employers Association (Apindo), who said that 80 per cent of those who took part in strikes and demonstrations were hired to do so and were not union members.<br />
<br />
The protests came despite Industry Minister Mohamad S. Hidayat's announcement on Monday that the government may raise the minimum wage to 2 million rupiah (US$207) a month, and that Jakarta's minimum wage may go up by 50 per cent.<br />
<br />
The labour leaders' statements show a growing distrust of the government and increasing boldness on the part of workers to demonstrate for change.<br />
<br />
A nationwide strike in early October crippled production at 1,000 factories, causing an estimated 1 trillion rupiah in losses, Apindo claimed.<br />
<br />
These protests have been rising in frequency even as Indonesia posted strong growth and attracted a record US$5.9 billion in foreign direct investment in the third quarter of this year. Singapore was one of the top investors.<br />
<br />
A survey by the Organisation for Economic Cooperation and Development September found that Indonesia's minimum wage is among the highest in the world relative to average salaries at 65 per cent. But labour leaders say it is not enough as the minimum wage is set based on an unmarried worker's needs, and the lack of monitoring allows many companies to breach the requirement and flout laws on limiting contract jobs.<br />

Manpower Minister Muhaimin Iskan- dar has been busy talking to provincial wage councils and governors, who have the authority to decide on the minimum wage, to consider more variables such as the needs of dependants and estimated future inflation.<br />
<br />
Aggressive action, such as workers forcing their way into factories to get others to strike, has unsettled many companies. Some Japanese and South Korean firms have sought help from their embassies to discuss the issue with the Manpower Ministry.<br />
<br />
Yesterday's protests in Purwakarta are the first of several scheduled over the next few days.<br />
<br />
On Saturday, MPBI officials will lead a meeting in Batam with about 50,000 workers. Next Monday, workers in Surabaya will take to the streets. On Tuesday, workers from industrial estates on the outskirts of Jakarta will march on the presidential palace and Parliament. Apindo says 23 companies have plans to suspend operations if demonstrations continue to be rowdy.<br />

The International Labour Organisation's deputy director Michiko Miyamoto describes the labour situation as complex, but says the main issue rests with the implementation of the law.<br />

"The biggest problem is the lack of clarity over the laws. Once this is resolved and the government shows the political will to implement this, workers and investors may be reassured."<br />

with higher purchasing power. However, businesses and investors claim that the wage hikes were a blow to competitiveness and would make setting up new businesses in the countries unattractive. Also, small and medium businesses would face the highest disadvantages, they argue.<br />
<br />
The ASEAN countries with notable minimum wage hikes are Thailand, Vietnam, the Philippines, Malaysia and Indonesia.<br />
<br />
<b>Thailand</b><br />
<br />
Thailand has started to raise the minimum wage gradually in provinces from April 2012 with the target to achieve a nationwide daily minimum wage of 300 baht (approximately $10) by 2013 which would benefit around 6.9 million workers who are currently paid below 300 baht daily. For some regions in the country the new minimum wage means salary increases of up to 40 per cent. Government officials have tied the wage hike to the need to raise skill levels and attract more advanced industries to Thailand as rival countries seek to compete on labour costs, but critics say the wage policy will not help industry in the short term.<br />
<br />
<b>Vietnam</b><br />
The Vietnamese Ministry of Labour in September has proposed to increase the monthly minimum wage from its current range of $67 – $96 to approximately $89 – $125, which would be an increase of around 33 per cent. The minimum wage increase proposal comes in light of the Vietnamese government calculations that current minimum wages only cover approximately 60 per cent of employees’ costs of living. Despite the extra financial burden of increasing the minimum wage, local companies have mostly supported the proposal.<br />
<br />
This minimum wage increase proposal comes despite Vietnam’s current economic difficulties. As of August 2012, over 30,000 companies in Vietnam have declared bankruptcy. As a result, the minimum wage increase now has been postponed from its originally planned date of January 2013 to March 2013 to ease the burden on local businesses. However, if businesses continue to suffer financially through the end of 2012, the date for the wage increase may be pushed back as far as September 2013. Around 8.3 million people in Vietnam will receive the raise.<br />
<br />
<b>The Philippines</b><br />
<br />
Starting this year, the Philippines has raised minimum wages by a cost of living allowance of about 15 per cent of the basic wage in Metro Manila, and other provinces are supposed to follow. Under the current system, daily minimum wages range from as low as $3.30 daily in retail or service establishments with 10 or less workers to as high as $10.37 daily for a non-agricultural worker in the national capital region.<br />
<br />
Nevertheless, minimum wages in the Philippines are substantially below the poverty threshold. In the national capital region, the poverty line is $15 a day for a family of five, or 50 per cent higher than the existing regional wage rates. In addition, nearly 30 per cent of all businesses do not comply with the minimum wage rates.<br />
<br />
The Philippine government has said it will dismantle the minimum wage system by 2013 and replace it with a two-tier scheme. This system will consist of a mandatory floor wage for new hires and low skilled workers as the first tier, and a productivity-based pay system as the second tier. A productivity-based pay system shall be issued in the form of wage advisories with industry-specific wage recommendations based on labour productivity growth, labour market conditions and business expectations, among others. The system will affect around 20 million workers.<br />

<b>Indonesia</b><br />
<br />
Indonesia may boost the average minimum wage in 2013 as labour groups demand higher pay amid economic growth that has exceeded 6 per cent for eight straight quarters.<br />
<br />
The Jakarta Wage Council decided on November 14 to recommend a massive 44 per cent increase in next year’s minimum wage for workers in the capital, much to the dismay of business representatives. If approved, this would mean Jakarta workers should next year receive no less than $230 per month. For the whole country, the government may raise the lowest required compensation to $208 a month.<br />

<b>Malaysia</b><br />
<br />
Malaysia has in May 2012 introduced a minimum wage for the first time in a move to support low income households. Private sector workers in Peninsular Malaysia will receive a minimum salary of $297 a month from January 1, 2013, and workers in the states of Sabah and Sarawak will get $264. Companies in labour-intensive industries, such as the rubber sector, have already asked the government to defer the new minimum wage as their labour costs would rise by 15 – 20 per cent. <br />

Computer maker Dell Inc is offering a voluntary separation scheme (VSS) to 700 of its Penang workers in a bid to cut costs and stay lean.<br />

The company yesterday announced that it will stop shipping its notebook computers from Penang to the US, Canada and parts of South America.<br />
<br />
Dell will, however, continue to export its laptops to Australia, New Zealand and South Asia from its Bukit Minyak facility on mainland Penang.<br />
<br />
Besides Penang, Dell has eight other manufacturing plants scat-tered around the world.<br />
<br />
In Asia Pacific, Dell's manufacturing plants include those in Xiamen, China and Chennai in India.<br />
<br />
Apart from making notebooks, the company also produces desktop computers, servers and storage products, which are manufactured to orders for global customers. <br />
<br />
"The 700 affected staff will include production operators, supervisors and managers," Dell Malaysia senior manager for corporate communications Jasmine Begum told Business Times. <br />
<br />
Dell, whose investment presence in Malaysia spans 14 years, has a total headcount of 4,500 and two facilities in Penang - one in Bukit Minyak and the other in Bayan Lepas on the island. <br />
<br />
The company also has a global business centre in Cyberjaya. <br />
<br />
Jasmine said the affected employees will begin to part ways with Dell beginning January 2010 and the company expects to conclude the VSS exercise by the middle of the year.<br />
<br />
"We will however continue to hire here," she added, "in line with the Malaysian government's call to enhance its employee base and take them up the value chain."<br />

implementation of the minimum wage scheme. He said this was to avoid burdening private sector employers should the minimum wage and minimum retirement age initiative be implemented together.<br />
"That is why the ministry is taking precautions, keeping in mind the interests of employers as well."<br />
He said the new retirement age could take effect at "another date next year, hopefully".<br />
<br />
In an immediate reaction, MTUC president Mohd Khalid Atan said the congress needed to meet the ministry urgently to clarify speculation on the new retirement age for private sector workers.<br />
<br />
He said MTUC leaders held a recent discussion with the ministry but were clueless as to the actual date of the implementation.<br />
MTUC in July had called on the private sector to extend the retirement age from 55 to 60 years immediately, given the six-month wait for bills to be gazetted and implemented.<br />
<br />
It said that in the meantime, thousands of workers reaching the mandatory age of 55 would be retiring. MTUC said it was concerned with these workers' status since they had made representations to it to seek re-employment.<br />
Human Resources Minister Datuk Seri Dr S. Subramaniam said the eligibility for invalidity pension for Social Security Organisation members would also be raised from 55 to 60.<br />

<b></b><b>KUALA LUMPUR, Sept 3</b> — Prime Minister Datuk Seri Najib Razak today announced that Tenaga Nasional Berhad (TNB) is the first government-linked company to raise the retirement age from 56 to 60.<br />
<br />
He said this was in accordance with the implementation of the Minimum Retirement Age Act 2012 passed by Parliament recently.<br />
<br />
The prime minister also announced more good news for the TNB employees. He said the TNB board of directors and management have agreed to raise the employer’s rate of contribution to the Employees Provident Fund (EPF) for the 56-60 age period.<br />
<br />
He also said that new employees of TNB would contribute to the Social Security Organisation (Socso) beginning September 1 this year.<br />
<br />
Najib made the announcements when addressing an assembly of TNB employees at the TNB Sports Complex, here.<br />
<br />
The event was also followed live over a video telecast by almost 30,000 TNB employees throughout peninsular Malaysia and Sabah.<br />
<br />
Najib said he hoped that all TNB employees would garner better benefits and be more motivated to discharge their duties.<br />
<br />
“And, what was expressed by your representatives will be your firm commitment to work hard.<br />
<br />
“As such, TNB will excel and in 60 years from now, it will achieve greater excellence,” he said.<br />
<br />
Najib said the challenge for TNB now was to fulfil the key performance indicator (KPI) pertaining to supply of adequate electricity and energy at a high rate of reliability compared to the early stages where it had to supply power to small towns and the rural areas.<br />
<br />
“When we talk of quality, it goes with reliability. This does not apply just for domestic consumers but for industrial users such as in the sophisticated electrical and electronic fields where a slight disruption can result in huge losses,” he said. — Bernama<br />

Ketua pegawai eksekutif Malaysia Airlines (MAS) Ahmad Jauhari Yahya berkata syarikat itu tidak menolak kemungkinan untuk mengurangkan tenaga kerjanya dalam rancangan untuk meningkatkan pulangan secara agresif, selepas mencatat kerugian bersih RM2.5 bilion tahun lalu.<br />

Beliau juga enggan menjelaskan jumlah kakitangan yang ideal untuk MAS kerana ia merupakan "soal sensitif."<br />

Pengerusi MAS, Tan Sri Md Nor Yusof ketika mencelah dalam sidang media itu berkata, pihak pengurusan kini sedang mengadakan inventori untuk mengenalpasti apa yang patut dijalankan syarikat tersebut.<br />

Malaysia ratifies key international labour standard on occupational safety and health<br />

Geneva (ILO NEWS) – The Government of Malaysia deposited with the International Labour Office the instrument of ratification of the Promotional Framework for Occupational Safety and Health Convention, 2006 (No. 187). Malaysia is the 22nd member State to ratify the Convention.<br />

The instrument of ratification was presented by Malaysia’s Minister of Human Resources, Dr Subramaniam K. V. Sathasivam, to the Director General of the International Labour Organization (ILO), Mr Juan Somavia, at a ceremony on 7 June 2012 in the framework of the 101st International Labour Conference (ILC).<br />
<br />
In depositing this instrument, Mr Sathasivam said “This ratification is one of the measures taken by the Government to implement its Occupational Safety and Health Master Plan 2015 which aims to foster a preventative safety culture, develop company OSH management systems, and enhance the involvement of all stakeholders. It also reflects the commitment made by the Government of Malaysia in 2008 when it signed the Seoul Declaration on Safety and Health at Work”.<br />
<br />
Mr Somavia said “This ratification is an expression of commitment by the Government of Malaysia to ensure a solid legal basis for the promotion and implementation of an occupational safety and health policy in the country. Malaysia joins other member States that have made a formal commitment to implement the Convention and becomes the third country in Asia to do so after Japan and the Republic of Korea”.<br />
<br />
Convention No. 187 provides a framework for a coherent and systematic approach to occupational safety and health and promotes the recognition and application of other ILO Conventions on the issue. In ratifying this international instrument, Malaysia commits itself to continuous improvement of occupational safety and health by means of a national policy, a national system and a national programme aimed at the prevention of occupational injuries, diseases and deaths, through tripartism and social dialogue.<br />
<br />
The ILO estimates that 317 million workplace accidents and 2.3 million deaths occur worldwide every year. In the past decade the rate of work-related accidents in Malaysia has decreased by more than 40 per cent. The Malaysian Occupational Safety and Health Master Plan has the goal of reducing injuries by an additional 30 per cent and fatalities by 20 per cent by 2015.<br />
<br />
The ILC is the annual meeting of the 185 member States of the ILO. The mandate of this UN specialised agency includes promoting rights at work, decent employment opportunities, social protection and tripartite dialogue on work-related issues.<br />

KUCHING: Malaysian Trade Union Congress (MTUC) welcomes and fully supports the Minimum Retirement Age Bill in Parliament to set the retirement age for employees in the private sector to at least 60 years.<br />

In a media statement yesterday, MTUC secretary Andrew Lo said Malaysia had one of the lowest retirement age and amongst the highest life expectancy in the world.<br />
<br />
“Singapore, the Philippines, Laos, Thailand and even Brunei have extended the retirement age to between 60 and 65.”<br />
<br />
Lo said with Malaysia’s life expectancy at almost 76 coupled with a declining birth rate, it was projected to become an aged nation sooner. Among others, he said setting minimum retirement age to 60 would boost public finance through tax collection. He reasoned that if people worked longer they would pay taxes longer. More Malaysians were marrying and having children at a later age, he said, meaning at age 55, they would still have to support their children who would be still studying.<br />
<br />
“Allowing employees to continue working longer (on similar terms and benefits) will increase household income and reduce poverty.<br />
<br />
“Currently, 82 per cent of EPF contributors do not have enough savings to survive above the poverty line during their retirement. This can be drastically reduced if retirement age is increased to 60.”<br />
<br />
Lo also argued that increasing retirement age would not deny younger persons from entering the workforce.<br />
<br />
It should be noted that work done by a mature worker might not be the same as that done by youth or a graduate, he said.<br />
<br />
“A graduate accountant would not want to take over the work of a 55-year-old labourer.”<br />
<br />
He added that studies and experiences worldwide found no evidence that increasing the employment of older persons would reduce the employment opportunities of youth.<br />
<br />
Though Malaysia had an issue with unemployed graduates, he said this was caused by mismatch in qualifications and the needs of the industry, and not by increased retirement age.<br />
<br />
On the notion that Malaysian workers nearing retirement age ‘are deadwood’, he said it was very insulting to claim that those aged 54 and above were old, sick, unproductive and problematic.<br />
<br />
He stressed that age had nothing to do with productivity and efficiency.<br />
<br />
“A worker may be unproductive whether he is 30, 50, 54 or 56 years old. Older workers are generally as good as younger workers.<br />
<br />
“They show less absenteeism, lower turnover, fewer accidents, higher job satisfaction and more positive work values than younger workers.<br />
<br />
“They are less prone to work-related injuries, substance abuse and lifestyle health issues.”<br />

Dua bukti nyata yang dipaparkan di blog ini jelas menunjukkan kerajaan telah merangka cadangan untuk memansuhkan pengeluaran KWSP pekerja dari akaun 1 pada usia 55 tahun kepada usia 60 tahun bagi menyelaraskan dengan Rang Undang-Undang Umur Persaraan Minimum 2012. <br />

Akhbar media kerajaan - Berita Harian bertarikh <b>15/6/2012</b> melaporkan dan cuba mengelirukan pembaca dengan memaparkan dengan tajuk besar <b>'50 TAHUN KEKAL'</b> tetapi dalam masa yang sama melaporkan <b>'Pada masa sama pengeluaran penuh hanya boleh dibuat selepas mencapai umur persaraan 60 tahun, berbanding 55 tahun sekarang'.</b> Berita tersebut dipetik dari Pengurus Besar Perhubungan Awam KWSP, Nik Affendi Jaafar. <br />

Selain itu akhbar <b>Harian Express Sabah</b> pula melaporkan <b>Ahli Parlimen Sepanggar, Sabah - YB Eric Majimbun </b>telah mendapat jawapan bertulis dari pihak Kementerian Kewangan dalam sesi parlimen pada <b>20 Mac 2012</b> yang mengesahkan kerajaan akan melanjutkan usia persaraan dan pengeluaran KWSP ke 60 tahun. <br />

Ternyata dengan kedua-dua bukti tersebut, kerajaan sudah membuat perancangan awal untuk membatalkan pengeluaran KWSP pekerja pada usia 55 tahun dengan menggantikannya ke usia 60 tahun! Menteri Sumber Manusia sudah tentu akan menafikan hal ini kerana ianya dijangka akan mendapat tentangan dari kalangan pekerja dan juga aktivis pekerja.<br />

Terkini Presiden MCA - Datuk Seri Dr Chua Soi Lek mahu pekerja sektor swasta diberi pilihan mengeluarkan simpanan mereka dalam Kumpulan Simpanan Wang Pekerja (KWSP) apabila mencapai usia 55 tahun sekiranya usia persaraan dilanjutkan kepada 60 tahun.<br />
Beliau berkata ini kerana ada pekerja memerlukan wang simpanan mereka untuk Memenuhi keperluan mendesak seperti membiayai pendidikan anak dan penjagaan kesihatan ibu bapa, manakala ada pula yang berpendapat mereka wajar dibenar membuat pilihan mengenai masa untuk mengeluarkan simpanan masing-masing.<br />

“KWSP perlu melihat undang-undangnya yang sedia ada, tapi sebagai parti politik, pendirian kami ialah mereka (pekerja) perlu diberi pilihan mengeluarkannya pada usia 55 tahun," katanya kepada pemberita selepas mempengerusikan mesyuarat Jawatankuasa Pusat MCA di ibunegara pada 19 Jun 2012.<br />

Jika Menteri Sumber Manusia menafikan berita ini dan menuduh ada pihak-pihak sengaja mensensasikannya, maka beliau sewajarnya mengambil tindakan terhadap akhbar tersebut dan merujuk semula kepada pihak KWSP serta Kementerian Kewangan yang dilaporkan telah mengeluarkan kenyataan tersebut.<br />
<br />
Kerajaan tidak sepatutnya 'mengambil kesempatan' dari cadangan pelaksanaan Rang Undang-Undang Umur Persaraan Minimum 2012 dengan mengubah sesuatu yang melibatkan simpanan dan tabungan pekerja. Kerajaan wajar menimbangkan untuk membenarkan proses pengeluran sediada dikekalkan kepada mereka yang memilih persaraan pilihan 55 dimasa depan. Sepatutnya kerajaan boleh mengujudkan satu peruntukan akaun berasingan yang baru khas untuk caruman KWSP selepas usia 55 hingga 60 tahun seperti yang sedang diamalkan sekarang untuk kelompok pekerja yang meneruskan perkhidmatan selepas usia 55 tahun. <br />
<br />
Tindakan mengujudkan 'option' kepada pengeluaran KWSP juga dilihat lebih praktikal dalam menyelesaikan permasalahan komitmen kewangan pekerja yang akan bersara pada usia 55 tahun. Kebanyakan pekerja swasta bergantung harapan kepada simpanan KWSP untuk menampung beban kewangan pelajaran anak-anak, perubatan dan perancangan pasca persaraan. Bayangkan jika sesorang pekerja kilang terpaksa bekerja sebagai 'production line' dan bekerja berdiri hingga usia 60 tahun (terutama pekerja wanita) semata-mata kerana 'terikat' dengan kehendak peraturan jika dilaksanakan pengeluaran muktamad KWSP pada usia 60 tahun. Ianya juga akan mengujudkan situasi tidak produktif kerana pekerja terpaksa bekerja BUKAN untuk meningkatkan produktiviti tetapi hanya disebabkan kegagalan mengeluarkan KWSPnya.<br />

Dengan cara ini semua pihak akan merasa lega..hak pekerja dijamin..dan isu pekerja bila bersara akan cepat habis wang KWSP cepat dapat diatasi.<br />
<br />
Dari perkembangan mutakhir isu Usia Persaraan Minimum 2012 dan hubungkaitnya dengan pengeluaran KWSP...Pekerja sewajarnya sudah dapat meneka mengapa slogan KWSP sejak dahulu- 'Simpanan Hari Tua' dan bukannya 'Simpanan Hari Persaraan'<br />

Umur Persaraan Minimum<br />

KUALA LUMPUR: Pencarum Kumpulan Wang Simpanan Pekerja (KWSP) masih boleh mengeluarkan wang daripada Akaun Dua ketika mencapai umur 50 tahun walaupun umur persaraan minimum pekerja swasta ditingkatkan kepada 60 tahun mulai tahun depan.<br />

Pada masa sama pengeluaran penuh hanya boleh dibuat selepas mencapai umur persaraan 60 tahun, berbanding 55 tahun sekarang. Peraturan itu selaras dengan penetapan umur persaraan minimum kakitangan swasta menerusi Rang Undang-Undang Umur Persaraan Minimum 2012 yang dibentangkan untuk bacaan kali pertama di Parlimen kelmarin dan berkuat kuasa mulai Januari 2013.<br />
Pengurus Besar Perhubungan Awam KWSP, Nik Affendi Jaafar, bagaimanapun berkata pihaknya memberi tempoh peralihan kepada 13 juta pencarumnya merancang kewangan persaraan mereka ketika menyelaras had umur pengeluaran 55 tahun kepada 60 tahun.<br />

Kita akan mengambil kira semua maklum balas, namun memandangkan objektif umur pengeluaran 55 tahun bagi membiayai per-saraan, KWSP perlu menyelaraskannya dengan umur persaraan minimum berkenaan.<br />
<br />
Dalam menguatkuasakan sebarang perubahan dalam umur pengeluaran, notis diberikan lebih awal bagi membolehkan pencarum merancang dan menyesuaikan persaraan mereka sewajarnya, katanya ketika dihubungi, semalam.<br />
<br />
Sementara itu, Timbalan Menteri Sumber Manusia, Datuk Maznah Mazlan, berkata penetapan umur persaraan minimum itu memerlukan pindaan dan penyelarasan caruman Pertubuhan Keselamatan Sosial (PERKESO). Katanya, penetapan umur persaraan minimum 60 tahun akan membabitkan lebih 10 juta pekerja swasta yang sebelum ini tidak ada umur persaraan minimum.<br />
<br />
Peningkatan umur persaraan minimum akan meningkatkan jaringan keselamatan sosial pekerja swasta yang bergantung kepada KWSP untuk faedah persaraan dan PERKESO. Caruman mereka bertambah lima tahun dengan simpanan lebih banyak. Kebajikan ketika persaraan lebih terjaga, katanya.<br />
<br />
Maznah berkata, penetapan umur persaraan minimum itu juga sejajar dengan perubahan jangka hayat rakyat Malaysia yang meningkat kepada 72 tahun bagi lelaki dan 77 tahun bagi perempuan.<br />
<br />
Secara purata, jangka hayat penduduk Malaysia adalah 74 tahun dan angka ini jauh lebih tinggi daripada purata jangka hayat sebelum ini, katanya.<br />

MTUC Sarawak Division Secretary Andrew Low said unfortunately, the restrictive Trade Unions Act does not allow general unions for workers and membership of any trade union is confined to only those who are employees in a particular industry, establishment, trade and occupation.<br />
<br />
He said a trade union enhances the economic status of its members; improves working conditions; boosts their productivity and job value and provides protection against discrimination and unfair treatment.<br />
<br />
"A bank employee can only be a member of a Banking Union...he cannot be a member of an airline union or teachers union and a hotel employee, a timber worker or a labourer cannot be members of the same union," he said in an email to Bernama here today.<br />
<br />
He said for enterprise or in-house unions, membership was only for employees of that particular establishment or company and even employees of a subsidiary or an associate company cannot join that particular union.<br />
<br />
Andrew said data showed that only 3.74 percent of the workers in the private sector are union members and only 2.11 percent are covered by a collective agreement. <br />
<br />
He said there has been a huge increase, 58 percent, in the number of in-house unions but the actual membership increased by only 12 percent while the workforce actually increased by 67 percent.<br />
<br />
"This means that most unions have less than 500 members and quite a number have less than 50 members," he added.<br />

“perjanjian kolektif” mempunyai makna yang sama dalam seksyen 2 Akta Perhubungan Perusahaan 1967 [Akta 177];<br />

“kontrak perkhidmatan” ertinya mana-mana perjanjian sama ada secara lisan atau bertulis, dan sama ada secara nyata atau tersirat, yang menurutnya seseorang bersetuju untuk mengambil bekerja seorang lain sebagai pekerja dan orang yang lain itu bersetuju untuk berkhidmat dengan majikannya sebagai pekerja;<br />

Ketua Pengarah” ertinya –<br />
(a) berkenaan dengan Semenanjung Malaysia, Ketua Pengarah Tenaga Kerja yang dilantik di bawah subseksyen 3(1) Akta Kerja 1955 [Akta 265];<br />

(b) berkenaan dengan Sabah, Pengarah Tenaga Kerja yang dilantik di bawah subseksyen 3 (1) Ordinan Buruh Sabah (Bab 67); atau<br />

(c) berkenaan dengan Sarawak, Pengarah Tenaga Kerja yang dilantik di bawah subseksyen 3 (1) Ordinan Buruh Sarawak (Bab 76); <br />

“pekerja” ertinya mana-mana orang yang memasuki, dan bekerja, di bawah suatu kontrak perkhidmatan dengan seorang majikan tanpa mengira gajinya tetapi tidak termasuk seseorang yang diperihalkan dalam Jadual;<br />

“majikan” ertinya mana-mana orang yang membuat kontrak perkhidmatan untuk mengambil bekerja seseorang yang lain sebagai pekerja dan termasuk ejen, pengurus atau faktor bagi orang yang mula-mula disebut itu;<br />
<br />
“Pegawai Tenaga Kerja” ertinya pegawai-pegawai yang dilantik di bawah subseksyen 3(2) Akta Kerja 1955, subseksyen 3(1A) Ordinan Buruh Sabah dan subseksyen 3(1A) Ordinan Buruh Sarawak;<br />
<br />
“Mahkamah Perusahaan” mempunyai makna yang sama dalam Akta Perhubungan Perusahaan 1967 [Akta 177];<br />
<br />
“umur persaraan minimum” ertinya umur persaraan seperti yang diperuntukkan di bawah subseksyen 4(1) atau umur persaraan minimum yang lebih tinggi yang ditetapkan oleh Menteri di bawah subseksyen 4(2);<br />
<br />
“Menteri” ertinya Menteri yang bertanggungjawab ke atas hal ehwal sumber manusia;<br />
“persaraan pramatang” ertinya seseorang pekerja dibersarakan secara pramatang sebelum pekerja mencapai tempoh umur persaraan minimum, tidak termasuk persaraan secara sukarela atau di mana perkhidmatan pekerja tersebut diberhentikan atas sebab-sebab lain selain daripada faktor umur;<br />
<br />
"Menetapkan" ertinya ditetapkan oleh peraturan;<br />
<br />
“Persaraan” ertinya penamatan perkhidmatan pekerja atas alasan umur;<br />
<br />
“Akta ini” termasuk mana-mana perundangan subsidiari yang dibuat di bawah Akta.<br />
<br />
BAHAGIAN II<br />
UMUR PERSARAAN MINIMUM<br />
<br />
Umur Persaraan Minimum<br />
<br />
4. (1) Walau apapun undang-undang bertulis lain, kontrak perkhidmatan atau perjanjian kolektif, umur persaraan minimum seseorang pekerja itu hendaklah apabila mencapai umur 60 tahun. <br />
<br />
(2) Walau apapun peruntukan subseksyen (1), Menteri boleh, melalui pemberitahuan dalam Warta, menetapkan umur persaraan minimum yang lebih tinggi.<br />
<br />
(3) Apabila Menteri menetapkan umur persaraan minimum yang lebih tinggi, umur persaraan minimum tersebut akan menggantikan umur persaraan minimum yang ditetapkan dalam subseksyen (1).<br />
<br />
4) Seseorang majikan tidak boleh yang membersarakan secara pramatang seseorang pekerja sebelum pekerja itu mencapai umur persaraan minimum.<br />
<br />
(5) Mana-mana majikan yang melanggar subseksyen (4) adalah melakukan satu kesalahan dan apabila disabitkan boleh dikenakan hukuman denda tidak melebihi sepuluh ribu ringgit.<br />
<br />
Umur Persaraan Pilihan<br />
<br />
5. Walau apa-apa pun yang dinyatakan dalam Akta ini, seseorang pekerja boleh bersara apabila mencapai umur persaraan pilihan, yang dipersetujui dalam kontrak perkhidmatan atau perjanjian kolektif.<br />
<br />
Ketidaksahan terma kontrak perkhidmatan<br />
<br />
6. (1) Apa-apa umur persaraan dalam kontrak perkhidmatan atau perjanjian kolektif yang dibuat sebelum atau pada atau selepas tarikh kuatkuasa Akta ini adalah lebih rendah daripada umur persaraan minimum yang dinyatakan dibawa Akta ini hendaklah disifatkan sebagai terbatal dan digantikan dengan umur persaraan minimum yang telah ditetapkan di bawah Akta ini.<br />
<br />
(2) Mana-mana terma dalam kontrak perkhidmatan atau perjanjian kolektif yang berhubung dengan umur persaraan hendaklah terbatal jika ianya mengecualikan atau menghadkan kuatkuasa mana-mana peruntukan Akta ini.<br />
<br />
Kuasa Ketua Pengarah untuk menyiasat aduan<br />
<br />
7. (1) Mana-mana pekerja yang telah dibersarakan oleh seseorang majikan sebelum pekerja mencapai umur persaraan minimum, boleh dalam tempoh enam puluh hari dari tarikh persaraan itu, membuat aduan secara bertulis kepada Ketua Pengarah.<br />
<br />
(2) Tertakluk kepada subseksyen (1), jika pekerja itu telah membuat representasi untuk pembuangan kerja tanpa sebab berpatutan di bawah seksyen 20 Akta Perhubungan Perusahaan 1967. <br />
<br />
<br />
(3) Jika seseorang pekerja membuat aduan di bawah subseksyen (1), Ketua Pengarah boleh menjalankan satu siasatan, mengikut cara yang ditetapkan oleh Menteri, untuk menentukan sama ada pekerja tersebut telah dibersarakan oleh majikannya bertentangan dengan peruntukan di bawah Akta ini.<br />

(4) Tertakluk kepada subseksyen (1), Ketua Pengarah boleh menjalankan satu siasatan, mengikut cara yang ditetapkan oleh Menteri, untuk menentukan sama ada terdapat keterangan prima facie bahawa pekerja itu telah dibersarakan secara pramatang oleh majikannya bertentangan dengan peruntukan Akta ini.<br />
<br />
(5) Selepas siasatan di bawah subseksyen (3), sekiranya Ketua Pengarah -<br />
<br />
(a) berpuas hati bahawa aduan pekerja adalah tidak berasas, Ketua Pengarah boleh menolak aduan itu;<br />
<br />
(b) berpuas hati bahawa pekerja itu telah dibersarakan oleh majikan bertentangan dengan peruntukan Akta ini, Ketua Pengarah boleh, tertakluk kepada subseksyen (6), mengarahkan majikan-<br />
<br />
(i) untuk mengembalikan pekerja itu kepada pekerjaan asalnya dan membayar pekerja itu tunggakan gaji yang dikira dari tarikh pekerja itu telah dibersarakan sehingga tarikh pengembalian kerja; atau<br />
<br />
(ii)untuk membayar pekerja pampasan sebagai ganti pemulihan kerja, tidak melebihi jumlah keseluruhan gaji pekerja itu yang dikira dari tarikh pekerja itu telah bersara kepada tarikh pekerja itu mencapai umur persaraan minimum.<br />
<br />
(6) Walau apapun had masa dinyatakan dalam subseksyen 20(1A) Akta Perhubungan Perusahaan 1967, tiada apa-apa dalam peruntukan di bawah seksyen 7 disifatkan menghalang pekerja untuk membuat representasi berhubung dengan pembuangan tanpa sebab yang munasabah di bawah seksyen 20 Akta Perhubungan Perusahaan 1967 jika Ketua Pengarah menolak aduan di bawah peruntukan subperenggan 5(a) Akta, 30 hari selepas keputusan dibuat di bawah subperenggan 5(a) disampaikan.<br />
<br />
(7) Walau apapun subseksyen 6 Akta, seseorang pekerja tidak berhak untuk membuat representasi di bawah seksyen 20 Akta Perhubungan Perusahaan 1967 jika pekerja itu telah memfailkan rayuan di bawah seksyen 9 Akta terhadap keputusan Ketua Pengarah di bawah subperenggan 5(a) Akta. <br />
<br />
(8) Jika Ketua Pengarah membuat satu keputusan di bawah subseksyen (4), seseorang pekerja tidak berhak kepada apa-apa tuntutan lain kerana pembuangan kerja tanpa sebab berpatutan di bawah seksyen 20 Akta Perhubungan Perusahaan 1967<br />
<br />
(7) Bagi maksud seksyen ini, "gaji" -<br />
<br />
(a) bagi seorang pekerja yang dinyatakan di bawah Jadual Pertama Akta Kerja 1955, Ordinan Buruh Sabah atau Ordinan Buruh Sarawak, mempunyai erti yang sama yang diberikan kepadanya dalam seksyen 2 Akta Pekerjaan 1955, seksyen 2 Ordinan Buruh Sabah atau seksyen 2 Ordinan Buruh Sarawak;<br />
<br />
(b) bagi seorang pekerja yang tidak dinyatakan di bawah Jadual Pertama Akta Pekerjaan 1955, Ordinan Buruh Sabah atau Ordinan Buruh Sarawak, ertinya kadar gaji dalam kontrak perkhidmatan.<br />
<br />
Rujukan kepada Mahkamah Tinggi bagi persoalan undang-undang<br />
<br />
8. (1) Dalam apa-apa siasatan di bawah subseksyen 7(3), Ketua Pengarah boleh, jika difikirkannya patut, merujuk apa-apa persoalan undang-undang bagi keputusan Hakim Mahkamah Tinggi dan jika Pengarah berbuat sedemikian dia hendaklah membuat satu keputusan dalam siasatan itu selaras dengan keputusan Hakim Mahkamah Tinggi.<br />
<br />
(2) Sesuatu rayuan ke atas mana-mana keputusan Hakim Mahkamah Tinggi di bawah subseksyen (1) hendaklah dibuat kepada Mahkamah Rayuan.<br />
<br />
<br />
<br />
Rayuan<br />
<br />
9. (1) Seseorang yang tidak berpuas hati dengan keputusan Ketua Pengarah di bawah subseksyen 7(4) boleh merayu kepada Mahkamah Tinggi.<br />
<br />
(2) Tertakluk kepada man-mana peraturan yang dibuat di bawah seksyen 4 of the Kaedah-Kaedah Mahkamah Rendah 1955 [Act 55], prosedur dalam sesuatu rayuan di Mahkamah Tinggi hendaklah menjadi prosedur dalam rayuan sivil dari Mahkamah Seksyen dengan ubahsuai mengikut keadaan yang perlu.<br />
<br />
Ketidakpatuhan kepada arahan Ketua Pengarah<br />
<br />
10. (1) Seseorang majikan yang gagal mematuhi arahan Ketua Pengarah di bawah perenggan 7(4)(b) adalah melakukan suatu kesalahan dan sekiranya disabitkan kesalahan, boleh dikenakan denda tidak melebihi sepuluh ribu ringgit.<br />
<br />
(2) Jika seseorang majikan telah disabitkan kesalahan di bawah subseksyen (1), mahkamah hendaklah memerintahkan majikan itu membayar jumlah yang diarahkan oleh Ketua Pengarah di bawah perenggan 7(4)(b).<br />
<br />
(3) Jika majikan gagal mematuhi perintah yang dibuat di bawah subseksyen (2), mahkamah hendaklah, atas permohonan pekerja, mengeluarkan satu waran untuk melevi harta majikan bagi amaun yang diperintahkan untuk dibayar di bawah subseksyen (2) dalam perkara-perkara berikut:<br />
<br />
(a) secara distress dan penjualan harta majikan itu mengikut tatacara yang sama seperti pelaksanaan di bawah Kaedah-Kaedah Mahkamah Rendah 1980 [P.U.(A) 328/80] dan pelaksanaan ini hendaklah terpakai mutatis mutandis walau apa pun amaun dalam perintah untuk dibayar; atau <br />
<br />
(b) mengikut cara yang sama seperti suatu denda sebagaimana yang diperuntukkan di bawah seksyen 283 Kanun Tatacara Jenayah [Akta 593].<br />
<br />
Kuasa Ketua Pengarah<br />
<br />
11. Ketua Pengarah hendaklah mempunyai semua kuasa untuk -<br />
<br />
(a) menyiasat apa-apa kesalahan di bawah Akta ini; dan<br />
<br />
(b) untuk menguatkuasakan mana-mana peruntukan di bawah Akta ini.<br />
<br />
Kuasa untuk menghendaki kehadiran dan memeriksa orang yang mempunyai pengetahuan tentang <br />
<br />
12. (1) Ketua Pengarah dalam membuat siasatan di bawah Akta ini boleh, melalui perintah secara bertulis, menghendaki kehadiran mana-mana orang yang mengetahui fakta dan hal keadaan kes itu, dan orang itu hendaklah hadir sebagaimana yang dikehendaki.<br />
<br />
(2) Jika seseorang enggan atau gagal untuk hadir sebagaimana yang dikehendaki, Ketua Pengarah boleh melaporkan keengganan atau kegagalan itu kepada seorang Majistret yang hendaklah mengeluarkan suatu saman untuk memastikan kehadiran orang itu sebagaimana yang dikehendaki oleh perintah yang dibuat di bawah subseksyen (1).<br />
<br />
<br />
(3) Ketua Pengarah boleh memeriksa secara lisan seseorang yang dikatakan mempunyai pengetahuan tentang fakta dan hal keadaan kes itu di bawah penyiasatannya.<br />
<br />
(4) Orang itu adalah terikat untuk menjawab semua soalan yang berhubungan dengan kes itu dalam siasatan yang diajukan kepadanya oleh Ketua Pengarah tetapi orang itu boleh enggan untuk menjawab mana-mana soalan yang jawapannya berkecenderungan mendedahkannya kepada pertuduhan jenayah atau penalti atau pelucutan hak.<br />
<br />
(5) Seseorang yang membuat pernyataan di bawah seksyen ini adalah terikat di sisi undang-undang untuk menyatakan yang benar, sama ada pernyataan itu dibuat keseluruhannya atau sebahagiannya dalam menjawab soalan atau tidak.<br />
<br />
(6) Ketua Pengarah yang memeriksa seseorang di bawah subseksyen (3) hendaklah terlebih dahulu memaklumkan orang itu tentang peruntukan subseksyen (4) dan (5).<br />
<br />
(7) Sesuatu pernyataan yang dibuat oleh mana-mana orang di bawah seksyen ini hendaklah diubah ke dalam bentuk bertulis dan ditandatangani oleh orang yang membuat pernyataan itu atau ditandakan dengan cap ibu jarinya selepas pernyataan itu telah dibacakan kepadanya dalam bahasa dia membuatnya dan selepas dia diberi peluang untuk membuat apa-apa pembetulan yang perlu.<br />
<br />
Kuasa untuk menghendaki pengemukaan dokumen<br />
<br />
13. (1) Ketua Pengarah yang membuat siasatan di bawah Akta ini boleh – <br />
<br />
(a) menghendaki mana-mana orang yang mempunyai pengetahuan tentang fakta dan hal keadaan kes itu untuk mengemukakan apa-apa kontrak perkhidmatan atau dokumen lain yang berhubungan dengan pekerjaan pekerja yang membuat aduan di bawah subseksyen 7 (1);<br />
<br />
(b) membuat salinan mana-mana kontrak perkhidmatan atau dokumen lain yang berhubungan dengan pekerjaan yang berkenaan dengan perenggan (a); dan<br />
<br />
(c) mengambil atau mengeluarkan apa-apa dokumen yang berkaitan.<br />
<br />
(2) Jika Ketua Pengarah berpuas hati bahawa dokumen itu tidak lagi perlu dipegang simpan, Ketua Pengarah boleh mengembalikan dokumen itu kepada orang yang memberikan dokumen itu dengan secepat yang dapat dilaksanakan.<br />
<br />
Pelaksanaan Kuasa Ketua Pengarah oleh Pegawai Tenaga Kerja<br />
<br />
14. (1) Tertakluk kepada subseksyen (2) dan apa-apa batasan sebagaimana yang ditetapkan oleh Menteri, seorang pegawai tenaga kerja boleh menjalankan semua kuasa yang diberikan kepada Ketua Pengarah di bawah Akta ini, dan setiap kuasa yang dijalankan hendaklah disifatkan telah dijalankan bagi maksud Akta ini.<br />
<br />
(2) Seorang pegawai tenaga kerja tidak boleh menjalankan mana-mana kuasa Ketua Pengarah di bawah Akta ini melainkan jika dia memiliki kad kuasa yang ditandatangani oleh Ketua Pengarah yang memberi kuasa kepada beliau untuk melaksanakan kuasa tersebut.<br />
<br />
<br />
Penalti Am<br />
<br />
15. Mana-mana orang yang melakukan kesalahan di bawah Akta ini yang tidak mempunyai sebarang penalti yang diperuntukkan dengan nyata hendaklah, apabila disabitkan, dikenakan denda tidak melebihi sepuluh ribu ringgit.<br />
<br />
Pendakwaan<br />
<br />
16. Tiada pendakwaan bagi suatu kesalahan di bawah Akta ini boleh dimulakan kecuali oleh atau dengan keizinan bertulis Pendakwa Raya.<br />
<br />
Kompaun Kesalahan <br />
<br />
17. (1) Ketua Pengarah boleh, dengan keizinan secara bertulis Pendakwa Raya, mengkompaun apa-apa kesalahan yang dilakukan oleh mana-mana orang di bawah Akta ini yang ditetapkan sebagai kesalahan boleh kompaun dengan membuat suatu tawaran bertulis kepada orang yang melakukan kesalahan itu untuk mengkompaun kesalahan itu apabila pembayaran kepada Ketua Pengarah suatu amaun wang yang tidak melebihi lima puluh peratus daripada amaun denda maksimum bagi kesalahan itu dalam masa yang dinyatakan dalam tawaran itu.<br />
<br />
<br />
(2) Sesuatu tawaran di bawah subseksyen (1) boleh dibuat pada bila-bila masa selepas kesalahan itu telah dilakukan, tetapi sebelum apa-apa pendakwaan baginya telah dimulakan, dan jika amaun yang dinyatakan dalam tawaran itu tidak dibayar dalam masa yang dinyatakan dalam tawaran itu atau dalam apa-apa tempoh lanjutan yang diberikan oleh Ketua Pengarah, pendakwaan bagi kesalahan itu boleh dimulakan pada bila-bila masa selepas itu terhadap orang yang kepadanya tawaran itu dibuat.<br />
<br />
(3) Jika suatu kesalahan telah dikompaun di bawah subseksyen (1), tiada pendakwaan boleh dimulakan berkenaan dengan kesalahan itu terhadap orang yang kepadanya tawaran untuk mengkompaun itu telah dibuat.<br />
<br />
Kuasa Menteri untuk meminda Jadual<br />
<br />
18. Menteri boleh, melalui suatu perintah yang disiarkan melalui Warta, meminda Jadual kepada Akta ini.<br />
<br />
Pengecualian<br />
<br />
19. Menteri boleh, melalui perintah yang disiarkan dalam Warta, mengecualikan dengan atau tanpa syarat mana-mana orang atau kumpulan orang dari semua atau sebarang peruntukan dalam Akta ini.<br />
<br />
Peraturan-peraturan<br />
<br />
20. Menteri boleh membuat apa-apa peraturan-peraturan sebagaimana perlu bagi maksud melaksanakan peruntukan Akta ini.<br />
JADUAL<br />
[Seksyen 2 Akta]<br />
<br />
1. Akta ini tidak terpakai untuk kategori berikut:<br />
(a) seseorang yang diambil bekerja secara tetap, sementara atau kontrak dan dibayar emolumen oleh Kerajaan Persekutuan, Kerajaan mana-mana Negeri, mana-mana badan berkanun atau mana-mana pihak berkuasa tempatan;<br />
<br />
(b) seseorang dalam tempoh percubaan;<br />
<br />
(c) seseorang perantis yang bekerja di bawah kontrak perantisan;<br />
<br />
(d) pekerja bukan warganegara;<br />
<br />
(e) pembantu rumah;<br />
<br />
(f) seseorang yang diambil bekerja dalam apa-apa pekerjaan dengan purata waktu bekerjanya tidak melebihi tujuh puluh peratus waktu bekerja biasa seseorang pekerja sepenuh masa;<br />
<br />
(g) pelajar yang bekerja di bawah mana-mana kontrak untuk tempoh sementara tetapi tidak termasuk pekerja yang mengambil cuti sambil belajar dan pekerja yang sedang belajar secara separa masa.<br />
<br />
(h) seseorang yang diambil bekerja untuk tempoh tetap termasuk apa-apa perlanjutan masa tidak melebihi 24 bulan; dan<br />
<br />
(i) seseorang yang, sebelum tarikh permulaan kuat kuasa Akta ini, telah bersara pada usia 55 tahun atau ke atas dan kemudiannya bekerja semula selepas beliau bersara.<br />
<br />
2. Bagi tujuan Jadual ini –<br />
<br />
(a) “pekhidmat domestik” mempunyai makna yang sama dalam seksyen 2 Akta Kerja 1955 [Akta 265];dan<br />
<br />

Announcement of National Minimum Wages Rates for the Private Sector<br />
<br />
1. The Prime Minister YAB Datuk Seri Najib Abdul Razak announced the rates of<br />
<br />
national minimum wages on 30th April 2012. The minimum wages shall be as<br />
<br />
follows: <br />
<br />
Peninsular Malaysia - RM900.00<br />
<br />
Sabah, Sarawak and Federal Territory of Labuan - RM800.00.<br />
<br />
<br />
2. Minimum wages under the National Minimum Wages Consultative Act 2011 is<br />
<br />
defined as basic wages determined under Section 23 of the Act.<br />
<br />
<br />
3. However, for the purposes of implementing minimum wages, payments in cash<br />
<br />
and cash incentives paid to the employees, the definition of wages under<br />
<br />
Section 2 of the Employment Act 1955 may be converted to be part of the<br />
<br />
minimum basic wages. <br />
<br />
<br />
4. In determining what allowances that may be converted into basic wages,<br />
<br />
members should be guided by the Industrial Court Award in the case of<br />
<br />
Rothmans of Pall Mall (Malaysia) Bhd. v. Rothmans Employees’ Union (Award<br />
<br />
97 of 1996) (a copy of the Award No. 97/96 is enclosed) where the Court decided<br />
<br />
that the following allowances are within the definition as wages under Section 2<br />
<br />
of the Employment Act 1955:<br />

5. Members are also advised that travelling allowance is not part of wages, under<br />
<br />
the definition of wages under Section 2 of the Employment Act 1955. However,<br />
<br />
employers may with the consent of the employees convert the said travelling<br />
<br />
allowance to be part of basic minimum wages.<br />
<br />
<br />
6. Please be advised that the implementation of minimum wages would only take<br />
<br />
effect 6 months (12 months for micro enterprises) from the date the Order is<br />
<br />
gazetted by the Minister of Human Resources.<br />
<br />
<br />
7. In the event an employer is unable to implement the minimum wages within<br />
<br />
the time frame as stated above, the employer may apply to the National<br />
<br />
Wages Consultative Council (NWCC) within 6 months from the date of gazette<br />
<br />
to review the implementation date of the minimum wages.<br />
<br />
<br />
8. Please be informed hotels may convert part or all of the service charges to be<br />
<br />
part of basic salary in order to arrive at the minimum wages of<br />
<br />
RM900.00/RM800.00.<br />
<br />
<br />
9. For the plantation industry, the RM200.00 which was paid as part of gratuitous<br />
<br />
payment may be converted as part of the minimum wages requirement.<br />
<br />
<br />
10. Those exempted from the ruling on minimum wages include Trainees,<br />
<br />
Apprentices, and Domestic Servants.<br />
<br />
<br />
11. Please be advised that foreign workers legally working in the country shall be<br />
<br />
covered by the minimum wages requirement. <br />
<br />
12. Further advice on the above will be issued from time to time especially when<br />
<br />
the Minister of Human Resources gazettes the Order on National Minimum<br />
<br />
Wages.<br />

<b>KUALA LUMPUR:</b> Tenaga Nasional Bhd melantik Datuk Azman Mohd sebagai presiden dan ketua pegawai eksekutifnya yang baharu berkuat kuasa 1 Julai, menggantikan Datuk Seri Che Khalib Mohd Noh yang kontraknya berakhir pada Jun.<br />

Azman, 55, yang ketika ini merupakan Pengarah Eksekutif dan Ketua Pegawai Operasi TNB akan menerajui gergasi utiliti itu bagi tempoh tiga tahun, kata syarikat tersebut dalam kenyataan kepada Bursa Malaysia hari ini.<br />
<br />
Beliau memulakan kerjayanya di syarikat itu pada 1979 sebagai jurutera elektrik di pejabat TNB daerah Temerloh/Mentakab dan kemudiannya perlahan-lahan mengisi jawatan korporat sejak 31 tahun lalu dengan memegang beberapa jawatan penting termasuk sebagai Naib Presiden (Pengedaran) dari 2008 hingga 2010.<br />
<br />
Semasa menerajui Bahagian Pengedaran, beliau menekankan kepada kepentingan meningkatkan perkhidmatan pelanggan menerusi pengenalan Piagam Pelanggan dan Standard Perkhidmatan Dalaman.<br />
<br />
Azman terlibat dalam Persidangan Antarabangsa mengenai Pengedaran Elektrik Malaysia dan dilantik sebagai pengerusi dari 2008 hingga 2010.<br />
<br />
Beliau kini terlibat dalam menubuhkan Institut Pengurusan Aset (IAM UK)Bahagian Malaysia.<br />
<br />
Azman, yang memegang Ijazah Sarjana Muda Kejuruteraan (Kejuruteraan Elektrik) dari University of Liverpool, United Kingdom, turut memiliki ijazah Sarjana dalam Pentadbiran Perniagaan dari Universiti Malaya. -BERNAMA<br />
